1. Introductory provisions

1.1. These General Terms and Conditions govern the rights and obligations between OOZI s.r.o. as the seller and the customer in connection with the purchase of the QZ device and the use of the related digital service QZ Foresight.

2.3. QZ is an informational and warning system. It does not replace professional battery diagnostics, vehicle service inspection, a charger, a maintenance charger, or a decision by a qualified service provider.

2.4. QZ does not guarantee that the vehicle will always start, nor that it will detect every possible fault of the battery, electrical system, alternator, starter, control units, or other vehicle components.

3. Order and conclusion of the contract

3.1. The customer places an order by selecting the product, number of devices, service package, filling in the required details and submitting the order via the website or payment gateway.

3.2. Before submitting the order, the customer can check and correct the entered details.

3.3. The contract is concluded at the moment the seller confirms the order or the payment is successfully completed, whichever occurs first.

3.4. The seller may refuse an order, in particular in the event of product unavailability, an obvious pricing error, suspected misuse of the ordering process, or inability to deliver the product to the customer's country.

4. Price and payment terms

4.1. The price of the product and service is shown on the website for the specific offer and in the order process before payment confirmation.

4.2. For sales to consumers, prices are shown including VAT.

4.3. For sales to entrepreneurs established in Slovakia, Slovak VAT is charged in accordance with applicable law.

4.4. For sales to entrepreneurs established in another EU Member State with a valid VAT identification number, the reverse charge mechanism may apply if the legal conditions are met. The customer is responsible for entering correct and valid billing details.

4.5. The delivery price is shown during the order process before the order is submitted.

4.6. Payment is processed through the Stripe payment gateway or another payment method shown during the order process.

4.7. The seller does not process the full payment card number. Payment details are processed by the payment gateway provider.

5. QZ Foresight service and automatic renewal

5.1. If the product offer states that the first period of the QZ Foresight service is included in the price, the service is provided during that period without an additional fee.

5.2. After the included or paid period expires, the QZ Foresight service is automatically renewed through the Stripe payment gateway if the customer agreed to automatic recurring billing during the order or service activation.

5.3. The renewal price depends on the selected package and is always shown to the customer before payment confirmation.

5.4. Before confirming automatic renewal, the customer is informed in particular about the price, billing frequency, payment method and cancellation option.

5.5. The customer may cancel automatic renewal in the customer account, through the available customer or payment portal, or by contacting support at support@kyuzet.com.

5.6. Cancellation of automatic renewal does not cancel an already paid service period. The service remains available until the end of the current paid period, unless stated otherwise.

5.7. If the customer does not renew the service after the included or paid period expires, the device may stop sending alerts or the scope of functions may be limited.

6. Delivery of goods

6.1. The seller delivers the goods to the address provided by the customer in the order.

6.2. The estimated delivery time is shown during the order process. If not stated, the seller will deliver the goods without undue delay, no later than within the statutory period.

6.3. The customer is obliged to check the integrity of the shipment upon receipt. We recommend reporting visible shipment damage immediately to the carrier and the seller.

6.4. The risk of damage to the goods passes to the consumer upon receipt of the goods. For entrepreneurs, the risk of damage may pass upon handover of the goods to the carrier, if permitted by applicable law.

7. Device activation and use of the service

7.1. The QZ device is activated according to the seller's instructions, usually via a QR code and the web application.

7.2. The customer is obliged to provide true and up-to-date details required for activation, in particular e-mail, vehicle details and battery type, if required.

7.3. The customer is obliged to install the device according to the instructions. In case of uncertainty, difficult access to the battery, or risk of incorrect installation, we recommend installation by a professional service provider.

7.4. The customer must not use the device in a way that conflicts with its purpose, technical specification or applicable law.

7.5. The customer acknowledges that the functionality of the service depends on several factors, in particular mobile signal, network availability, correct installation, battery condition, cloud service availability and the accuracy of the entered data.

8. Service and liability limitations

8.1. QZ evaluates selected data from the device, in particular battery voltage, time patterns, driving or stationary states, location and contextual data. QZ evaluates this data using fixed pre-defined rules and does not use machine learning to decide on battery condition.

8.2. QZ may not detect in particular:

8.3. Recommendations from the QZ Foresight service are informational. The final decision about driving, charging, servicing or replacing the battery is made by the customer.

8.4. The seller is not liable for indirect damage, loss of profit, delayed deliveries, vehicle immobilisation, towing costs, missed meetings, fleet downtime or other consequential loss, to the extent such limitation of liability is permitted by applicable law.

8.5. This limitation does not apply to damage caused intentionally, by gross negligence, or to liability that cannot be excluded under applicable law, including statutory liability for defective products under Directive (EU) 2024/2853.

9. Withdrawal from the contract by a consumer

9.1. A consumer has the right to withdraw from a distance contract without giving any reason within 14 days from the date of receipt of the goods.

9.2. Detailed instructions and the model withdrawal form are provided in the separate document Withdrawal from the Contract.

9.3. The consumer may test the device only to the extent necessary to determine its nature, characteristics and functionality. If the value of the goods is reduced due to handling beyond this extent, the seller may reasonably reduce the refunded amount.

9.4. If the consumer requests the start of provision of the digital service before the withdrawal period expires, the consumer acknowledges that, upon withdrawal, they may be required to pay a proportionate part of the price for the performance already provided, if permitted by applicable law.

10. Complaints and liability for defects

10.1. The customer's rights arising from liability for defects are governed by applicable law and the seller's Complaints Procedure.

11. Personal data protection

11.1. Information on the processing of personal data is provided in the document Personal Data Protection.

11.2. The customer acknowledges that the operation of the QZ Foresight service requires the processing of selected technical, telematics and contact data.

11.3. In the case of business use in vehicles used by employees or other persons, the customer is obliged to ensure their own legal basis, information of the data subjects and compliance with their obligations under personal data protection laws.

12. Alternative consumer dispute resolution

12.1. A consumer has the right to contact the seller with a request for remedy if they are not satisfied with the handling of a complaint or believe that the seller has violated their rights.

12.2. If the seller rejects the request or does not respond within the statutory period, the consumer has the right to submit a proposal to initiate alternative consumer dispute resolution to the competent entity.

12.3. The competent entity is in particular the Slovak Trade Inspection or another authorised entity listed in the register of alternative dispute resolution entities.

13. Final provisions

13.1. These Terms and Conditions are governed by the laws of the Slovak Republic and the relevant laws of the European Union.

13.2. If the customer is a consumer from another EU Member State, this does not affect their rights arising from mandatory provisions of the law of the country of their habitual residence.

13.3. The seller reserves the right to amend these Terms and Conditions. The version effective at the time the order is placed applies to the order.
